At ConwayMcColl Solicitors we discuss with our clients the options in terms of legal costs. Our aim wherever possible, is to have a fixed fee system. This means that after discussing an issue with our client, we will assess the work our clients wish us to undertake and explain what we anticipate the cost will be. More often than not, we will then be in a position to agree a fixed fee. If the matter is likely to span several months, as can be the case with an Employment Tribunal claim, we will set out a fixed fee for each stage of the process.

For businesses, we offer the option of a retainer service. For a fixed monthly fee, employers would be able to contact us as often as necessary for legal advice and support. Included in the monthly fee would be the drafting of letters on our clients behalf. This will give businesses the comfort of knowing that employees will be treated fairly and in line with the law whilst being reassured that the business will be better protected against Employment Tribunal claims.

A retainer service provides business with reassurance in terms of legal costs, enabling the business to plan and budget accordingly.

Both businesses and individuals may have legal expense insurance which may cover all or part of their legal costs. This is something we urge our clients to look into. Experience has taught us that legal expense insurance is often forgotten about, by individuals in particular.

If an employee or ex-employee is issued with a Settlement (previously ‘Compromise’) Agreement by their employer/former employer, the individual has to be legally advised, normally by a solicitor, in order for the agreement to be legally binding. Normally, the employer will pay for the legal costs in advising the individual on a compromise agreement, meaning we can invoice the employer directly.
