You have of course assisted in two main areas; the first being the provision of contracts of employment for our staff, and the second dealing with issues relating to a particular staff member. The second issue of course underlines the need for proper contracts of employment.

Recently ConwayMcColl Solicitors assisted in co-defending a claim against a client of Boss Projects LLP at an employment tribunal from a self-employed individual. As Boss Projects can only protect companies from the point of engagement, any previous engagement history must be defended by the client.
Conway McColl, in particular Pam, successfully defended the client at the hearing by completely discrediting the claimant in his personal statement and in his verbal testimony. The case was defended in a clear and precise manner and the justifications were reasoned and well-considered, leaving the judge little manoeuvrability and no other prospect than finding in the defendant’s favour. The case was defended successfully against the worker status and saved our mutual client thousands of pounds.

When I took on an apprentice, I considered writing my own apprenticeship agreement. I did a bit of Googling and made some notes, but in the interest of BNI, I decided to have a chat with Pam. After our first meeting, her questions made me realise that this was perhaps not something that I should attempt to do myself.
At our second meeting, Pam and I went through the first draft of the agreement and she also produced three documents that I hadn’t even considered having: A Social Media policy (rather important considering the nature of our business), Disciplinary and Capability Procedure and a Grievance Procedure. These cover such vital points that could have left me and my company vulnerable without them.
